APPLICANT REQUESTS THAT:
The Armed Forces Service Medal (AFSM) be added to his DD Form
214, Armed Forces of the United States Report of Transfer or
Discharge.

APPLICANT CONTENDS THAT:
The AFSM was not included on his DD Form 214.

Exhibit A.

STATEMENT OF FACTS:
On 17 Mar 69, the applicant commenced his enlistment with the
Regular Air Force. He was released from active duty on
16 Mar 73. He was credited with four years of active service,
which included one year and six months of foreign service.
The remaining relevant facts pertaining to this application are
contained in the letter prepared by the appropriate office of
the Air Force, which is attached at Exhibit C.

AIR FORCE EVALUATION:
AFPC/DPSID recommends denial indicating there is no evidence of
an error or injustice. The AFSM is awarded to service members
of the Armed Forces of the United States (US) who, after
1 Jun 92, participate, or have participated, as a member of US
military units in a US military operation that is deemed to be a
significant activity and encounter foreign armed opposition or
imminent threat of hostile action. Service members must be
members of a unit participating for one or more days in the
operation within the designated area of eligibility (AOE), or be
engaged in direct support for 30 consecutive days or for 60
nonconsecutive days, provided this support involves entering the
area of eligibility (AOE). However, the applicant served on
active duty prior to the authorization of the AFSM and is
therefore not eligible for the requested award. However, a
review of the applicants records revealed that he is entitled
to the Air Force Outstanding Unit Award with Valor (AFOUA v/V),
Vietnam Service Medal with two Bronze Service Stars (VSM
w/2BSS), Republic of Vietnam Gallantry Cross with Palm (RVNGC
w/P), Vietnam Campaign Medal (VCM), and Air Force Longevity
Service Award (AFLSA) and his records will be administratively
corrected.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 17 Feb 13, for review and comment within 30 days.
As of this date, no response has been received by this office
(Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicant's complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
and adopt its rationale as the basis for our conclusion the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting any relief beyond that rendered
administratively.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
